🔑 Key NAR Settlement Changes for Buyers and Sellers
1. More Transparency
The NAR Settlement ensures greater transparency in how broker and agent compensation is discussed and agreed upon. As a result, buyers and sellers are better informed before committing to any services.
2. Fully Negotiable Broker Fees
Broker and agent compensation is now even more flexible. Buyers and sellers can openly discuss options, compare services, and make informed choices before any agreements are signed.
3. Clear Disclosure of Compensation
All agreements must include a detailed breakdown of professional compensation. This means both parties understand costs from the start — no surprises later.
🛒 NAR Settlement Changes Specific to Home Buyers
4. Written Buyer Broker Agreements
Buyers must now sign a written agreement with their broker before touring homes. This agreement outlines services to be provided and the compensation structure — ensuring clarity for everyone.
5. Flexible Compensation Options
Buyers and their brokers can decide how compensation will be handled. Options may include:
- Direct payment from the seller to the buyer’s agent
- Seller-paid concessions that cover the buyer’s agent
- Buyer paying the agent directly
- Or a combination of these methods
In every case, brokers can only receive what was agreed upon in writing with the buyer.

6. Required Disclosure of Offered Compensation
If sellers choose to offer compensation to a buyer’s broker, that offer must be disclosed in writing and signed by the seller. This step ensures transparency and full awareness of all costs involved.
7. Changes to MLS Compensation Advertising
Starting August 17, 2024, offers of compensation may not appear in the MLS. However, sellers and listing brokers can still advertise compensation on websites, social media, printed materials, and signs. Therefore, communication channels are still open — just not through the MLS.

Sellers can still offer compensation to a buyer’s broker if they choose. This remains a powerful tool to increase showings and attract motivated buyers.
9. Seller Concessions Are Still Negotiable
Sellers may continue offering concessions to help with closing costs, rate buydowns, or even buyer agent fees. Buyers are still encouraged to negotiate these as part of their offer.
10. REALTORS® Still Uphold Ethical Standards
REALTORS® remain bound by a strict Code of Ethics. We continue to put your interests first, disclose all compensation clearly, and guide you with professionalism every step of the way.
💵 What This Means for Buyer Affordability
Many home buyers already face tight budgets after covering their down payment and closing costs. Paying a broker directly may not always be possible — especially since mortgages can’t include that fee.
When a seller offers compensation, it’s baked into the home’s price — and therefore included in the buyer’s mortgage. This helps buyers afford professional representation while keeping cash costs lower.
